These Terms and Conditions (“Terms”) govern your access to and use of the websites, products, and services offered by Daulcél and its affiliates (“Daulcél,” “we,” “us,” or “our”). By accessing our website or purchasing our products, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, without limitation or qualification.

1. Privacy

2. Products & Services

All products offered by Daulcél, including but not limited to nutraceuticals, IV therapies, dermo cosmetics, and anti-aging supplements, are provided strictly for personal, lawful, and non-commercial use. Any resale, distribution, or representation of Daulcél products without the prior express written consent of Daulcél is strictly prohibited. Daulcél reserves the exclusive right, at its sole discretion, to refuse service, cancel orders, or terminate customer accounts at any time and without prior notice, should there be a violation of these Terms and Conditions or if such action is deemed necessary to protect the best interests of Daulcél.

3. Eligibility

  • You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to purchase from us.
  • All IV injectables and related medical formulations offered under the Daulcél brand are strictly restricted to administration by licensed medical professionals. These products may only be purchased by, or on behalf of, a duly licensed healthcare provider who is authorized under applicable laws and regulations to administer such treatments. By completing a purchase of IV injectables, you confirm that you are a licensed medical professional or are purchasing on behalf of one, and that such products will be used only in a lawful and professional medical setting.

 

4. Ordering & Payment

All orders placed through the Site are subject to acceptance and product availability. Prices for all products are subject to change at any time without prior notice. Payment for orders must be made in full at the time of purchase through our secure third-party payment gateways. Daulcél shall not be liable for any errors, payment declines, or fraud prevention checks initiated by such gateways. We reserve the right, at our sole discretion, to refuse or cancel any order for reasons including, but not limited to, suspected fraudulent activity, inaccuracies in pricing or product information, or restrictions arising from applicable laws and regulations.

5. Returns & Refunds

All sales of Daulcél products are final, and no returns or refunds shall be permitted except in the limited circumstances expressly set forth herein. Returns or refunds will only be considered where a product is proven to have been damaged in transit or to be defective upon arrival. In such cases, the customer must notify Daulcél in writing within forty-eight (48) hours of receipt, providing clear photographic or video evidence of the alleged damage or defect. Products must remain unused, sealed, and in their original packaging in order to be eligible for replacement or refund consideration.

Daulcél reserves the right, at its sole discretion, to investigate all claims and to determine whether a replacement product or other remedy shall be provided. No refunds or replacements shall be issued in cases involving change of mind, taste preferences, delayed delivery, or any incorrect usage, storage, or handling by the customer.

 

6. Your Account

When you choose to create an account with Daulcél, you will be required to provide accurate, complete, and up-to-date information. You will be assigned or will create a username and password, and you are solely responsible for maintaining their confidentiality. You accept responsibility for all activities that occur under your account, whether conducted by you or someone using your credentials. If you are accessing or using the Site on behalf of another individual, you represent that you are duly authorized to bind that person as principal to these Terms and Conditions, and in the absence of such authority, you agree to be bound personally and assume liability for any wrongful or unauthorized use. If you have any reason to believe your account has been compromised, you must immediately notify Daulcél.

We reserve the right to refuse service, suspend, or terminate accounts at our sole discretion without notice if these Terms are violated or where we believe such action is necessary to protect our brand, users, or integrity. Daulcél will not be liable for any loss or damage resulting from unauthorized use of your account, regardless of whether we were notified.

 

7. Health & Safety Disclaimer

Daulcél products, including but not limited to nutraceuticals and intravenous therapies, are not intended to diagnose, treat, cure, or prevent any medical condition or disease. The use and administration of such products should take place only under the supervision and guidance of a duly qualified healthcare/medical professional, particularly in relation to injectable and anti-aging formulations. Outcomes and results may vary from person to person, depending upon factors such as individual physiology, medical history, and adherence to professional guidance. Daulcél expressly disclaims any liability arising from misuse, unsupervised administration, or failure to comply with medical advice or instructions relating to its products.

8. Intellectual Property

All trademarks, logos, text, graphics, designs, formulations, and all other content made available on this website or in connection with Daulcél’s products and services are the exclusive property of Daulcél or are used under valid license. Such intellectual property is protected by applicable laws, and no part thereof may be copied, reproduced, distributed, displayed, modified, or otherwise exploited in any manner without the express prior written consent of Daulcél. Any unauthorized use shall constitute a violation of Daulcél’s rights and may give rise to legal action.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Daulcél expressly disclaims all warranties, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement. Daulcél shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of its website or products, including but not limited to loss of profits, adverse reactions, or misuse of products. In no event shall the total aggregate liability of Daulcél, whether in contract, tort, or otherwise, exceed the purchase price actually paid for the specific product giving rise to the claim.

You agree to defend, indemnify, and hold harmless Daulcél, its affiliates, and each of their respective officers, directors, employees, agents, representatives, licensors, and partners from and against any and all claims, demands, liabilities, damages, losses, expenses, or costs, including but not limited to reasonable attorneys’ fees and legal expenses, arising out of or in connection with:

(i)               your use or misuse of the Site, Services, or Products;

(ii)             your violation of these Terms and Conditions or any applicable law;

(iii)            your infringement or violation of any intellectual property, privacy, or other rights of a third party; or

(iv)            any unauthorized or improper use of your account or credentials, whether by you or a third party.

This obligation to indemnify shall survive the termination or expiration of these Terms and Conditions and your use of the Site, Services, or Products. Termination of your account or access to our Services does not affect any rights or obligations that accrued prior to termination, including the enforcement of indemnification provisions.

 

12. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of India, without regard to principles of conflict of laws. Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or any products or services provided by Daulcél shall be submitted to and resolved exclusively by final and binding arbitration conducted on an individual basis in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall take place in Mumbai, Maharashtra, India, and shall be conducted in the English language.

You expressly waive any right to participate in, or seek to bring, a class action, representative action, or collective proceeding against Daulcél, its affiliates, officers, directors, employees, or agents. The arbitrator’s award shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

13. Modifications

Daulcél reserves the right to modify these Terms at any time. Continued use of the website or purchase of our products after updates constitutes acceptance of the revised Terms.
